BEFORE THE FLORIDA PUBLIC SERVICE COMMISSION
In re: Natural gas conservation cost recovery. DOCKET NO. 20260004-GU
ORDER NO. PSC-2026-0285-PCO-GU
ISSUED: August 20, 2026
ORDER GRANTING JOINT MOTION OF
FLORIDA PUBLIC UTILITIES COMPANY AND FLORIDA CITY GAS
REQUESTING ACCEPTANCE OF LATE-FILED PETITION FOR APPROVAL OF
COST RECOVERY FACTORS AND PROJECTION TESTIMONY AND EXHIBITS
Background
Order No. PSC-2026-0039-PCO-GU, 1 the Order Establishing Procedure (OEP),
established hearing procedures to govern this docket, including controlling dates. Pursuant to the
OEP, FPUC and FCG’s deadline to file their Joint Petition for Approval of Conversation Cost
Recovery Factors (Joint Petition) and associated testimony and exhibits was August 3, 2026. On
August 4, 2026, Florida Public Utilities Company (FPUC) and Florida City Gas (FCG) filed their
Joint Petition and associated testimony and exhibits along with a Joint Motion Requesting
Acceptance of Late-Filed Petition for Approval of Cost Recovery Factors and Projection
Testimony and Exhibits (Joint Motion).
As stated in their Joint Motion, FPUC and FCG were unable to file their Joint Petition
and associated testimony and exhibits before the deadline due to training of new personnel,
challenging workloads, and the late discovery of an unexpected error. FPUC and FCG informed
Commission staff and conferred with the parties on the evening of August 3, 2026, regarding the
Joint Motion to be filed the following afternoon. The Office of Public Counsel and Peoples Gas
System, Inc. did not oppose the Joint Motion, while St. Joe Natural Gas Company, Inc., and
Sebring Gas System, Inc. did not provide a response. FPUC and FCG ultimately filed their Joint
Motion, along with their Joint Petition with associated testimony and exhibits, at approximately
1:49 p.m. on August 4, 2026 —just under 6 business hours after the filings were due, as set forth
in the OEP.
Decision
Section IV of the OEP states “[f]ailure of a party to timely prefile exhibits and testimony
from any witness in accordance with the foregoing requirements may bar admission of such
exhibits and testimony.” (emphasis added). However, under the authority of Rule 28-106.211,
Florida Administrative Code (F.A.C.), the Joint Motion shall be granted. FPUC and FCG’s late-
filed Joint Petition and associated testimony and exhibits shall be accepted for filing because
there is no or very little prejudice to any of the parties and none of the parties objected to the
testimony and exhibits being admitted.

that is available under Sections 120.57 or 120.68, Florida Statutes, as well as the procedures and

Mediation may be available on a case-by-case basis. If mediation is conducted, it does
not affect a substantially interested person's right to a hearing.
Any party adversely affected by this order, which is preliminary, procedural or
