MIKE’S MACER DELIVERY LLC, ET. AL., Respondents ORDER RESCHEDULING HEARING This matter has been docketed for a hearing before the United States Department of Labor, Office of Administrative Law Judges (“OALJ”) pursuant to the employee protection provisions of the Taxpayer First Act of 2019 (“TFA”), 26 U.S.C. § 7623(d), and the implementing regulations at 29 C.F.R. § 1989. Pursuant to the Notice of Hearing Order issued on July 1, 2025, a hearing was scheduled for December 2, 2025. That hearing was subsequently canceled by Order issued on November 17, 2025, as discovery was not completed. The hearing was rescheduled for March 24, 2026, and canceled again via Order issued on March 19, 2026, due to discovery issues. The March 19, 2026 Order also directed Respondent’s Counsel to respond to Complainant’s proposed schedule by April 1, 2026. After he failed to do so, Complainant’s Counsel submitted a Motion to Enforce Order. On August 12, 2026, I granted the Complainant’s motion, in part, and directed the parties confer and provide five mutually acceptable dates on or before September 11, 2026. On September 30, 2026, the parties indicate their availability for a rescheduled hearing on several individual days, including January 20, 2027, and January 22, 2027. Based on the foregoing, it is hereby ORDERED that the videoconference hearing in this matter is hereby RESCHEDULED for 10:00 A.M. (EST) on January 20, 2027. If the hearing is not completed on January 20, 2027, it will resume on January 22, 2027. A Teams link will be provided to the parties closer to the date of the hearing. Also, the parties are reminded that, pursuant to the August 12, 2026 Order: 1. Any additional discovery responses must be received by the opposing party on or before October 12, 2026.
- 2 - 2. Any dispositive motions must be filed on or before November 13, 2026, with responses due on or before November 30, 2026. 3. The parties must exchange their respective exhibits and witness lists with each other and submit them, as well as any stipulations of fact and joint exhibits, to the undersigned on or before December 18, 2026. In addition, given the length of time this case has been pending, and considering the previous directive, the parties are reminded that any additional continuance requests will be denied unless there is compelling evidence of extraordinary circumstances. SO ORDERED. SEAN M. RAMALEY Administrative Law Judge
