The Federal Administrative Court granted the applicant’s complaint and admitted the revision. It held that the Hessian Administrative Court had diverged from later BVerwG case law on § 3(2) sentence 2 BauGB: when notifying public participation, municipalities must summarize the environmental issues dealt with in the available comments and materials by topic and describe them in catchwords; a mere reference to the environmental report does not suffice. Because the appellate judgment could be read as allowing a more general notice, revision was allowed under § 132(2) no. 2 VwGO.

Massima Omnilex

§ 132 Abs. 2 Nr. 2 VwGO; post hoc divergence as a ground for admission of revision; § 3 Abs. 2 Satz 2 BauGB. Revision is to be admitted where the challenged appellate judgment can be understood as adopting a legal proposition that conflicts with a subsequently rendered Federal Administrative Court decision. For the notice of public participation in land-use planning, municipalities must, in the public announcement, group the environmental subjects treated in the available statements and materials into subject blocks and identify them in catchword form; a general reference to the environmental report is not sufficient (consid. 2). A divergent legal view may also arise where the appellate decision permits, depending on the circumstances, a broad reference to the environmental report and to environmental statements of a general nature.

Questione giuridica chiave

Whether the complaint should be granted because the appellate judgment diverged from Federal Administrative Court case law under § 132(2) no. 2 VwGO.

Decisione estratta

Yes. The complaint was admissible and well-founded; revision had to be admitted due to post hoc divergence.

Motivazione estratta

A later BVerwG judgment required municipalities, when publishing the notice of public participation, to group environmental topics from the available comments and documents by subject blocks and characterize them in catchword form. A general reference to the environmental report is insufficient. The appellate court attributed a different rule, according to which an overall reference to the environmental report and broadly environmental statements could suffice depending on the circumstances.
