Gründe

1 Die Rechtsbeschwerde der Beteiligten zu 1 bis 3 ist gemäß § 83 Abs. 2 BPersVG i.V.m. § 72 Abs. 2 Nr. 1, § 92 Abs. 1 Satz 2 ArbGG zuzulassen. Die vorliegende Sache gibt dem Senat Gelegenheit, die Rechtseinheit hinsichtlich der Frage herzustellen, unter welchen Umständen im Verhinderungsfall nachgerückter Ersatzmitglieder der Jugendvertretung den Weiterbeschäftigungsschutz nach § 9 BPersVG genießen (vgl. Beschlüsse vom 25. Juni 1986 - BVerwG 6 P 27.84 - BVerwGE 74, 280 und vom 28. Februar 1990 - BVerwG 6 P 21.87 - BVerwGE 85, 5 einerseits sowie BAG, Urteil vom 13. März 1986 - 6 AZR 207/85 - BAGE 51, 261 andererseits).

2 Das Beschwerdeverfahren wird nunmehr als Rechtsbeschwerdeverfahren unter dem Az.: BVerwG 6 P 10.13 fortgesetzt. Mit der Zustellung dieses Beschlusses beginnt die Rechtsbeschwerdebegründungsfrist von 2 Monaten (§ 72a Abs. 6, § 74 Abs. 1, § 92 Abs. 2 Satz 1, § 92a Satz 2 ArbGG).
