1 Die Beschwerde der Beigeladenen ist begründet. Das Urteil des Verwaltungsgerichts weicht im Sinne des § 132 Abs. 2 Nr. 2 VwGO von dem Urteil des Senats vom 27. April 2006 - BVerwG 3 C 23.05 - (BVerwGE 126, 7) sowie von dem Beschluss des Senats vom 8. März 2010 - BVerwG 3 B 8.10 - (ZOV 2010, 148) ab. Während den Entscheidungen des Senats der Rechtssatz zugrunde liegt, dass der Lauf der in § 2 Abs. 5 Satz 1 VZOG genannten 2-Jahres-Frist mit Eintritt der Bestandskraft des Bescheides beginnt, stellt das Verwaltungsgericht auf den Zeitraum ab Eintritt der Wirksamkeit des Bescheides ab.
