The Federal Administrative Court upheld the complaint and admitted the revision. It considered the case of fundamental importance because the revision must clarify whether § 6(6a) sentence 3 alternative 3 VermG applies analogously when a company was deprived not of an enterprise but of a single asset, the asset no longer exists, and the company could not be revived due to lack of quorum. The court also noted unresolved questions about the scope of entitled persons in such a constellation. A provisional value for the revision proceedings was set.

Massima Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; analogous application of § 6 Abs. 6a sentence 3 alternative 3 VermG in singular restitution cases: Revision is to be admitted where the appeal raises a question requiring clarification whether the provision applies analogously if an enterprise claimant was deprived only of a single asset, the asset has meanwhile perished and return is impossible, and revival of the dissolved company failed for lack of quorum. The existing case-law on analogous application of § 6 Abs. 1a VermG to singular restitution claims does not preclude further development of the law; the scope of the entitled persons under the revival regime likewise remains open (consid. 1-2).

Titelzeile

Questione giuridica chiave

Whether the complaint justified admission of the revision for fundamental importance under § 132(2)(1) VwGO.

Decisione estratta

Yes. The case raises a question of fundamental significance requiring clarification in revision.

Motivazione estratta

The court held that it must be clarified whether § 6(6a) sentence 3 alternative 3 VermG applies by analogy when not an enterprise but a single asset was taken, and the asset cannot be returned because it has meanwhile ceased to exist and the company could not be revived due to lack of quorum.

Questione giuridica chiave

How to treat revival and entitlement issues in a singular restitution claim where the company no longer exists and quorum for revival was not reached.

Decisione estratta

The court did not decide the merits, but indicated that existing case-law on analogous application of revival rules may need further development.

Motivazione estratta

It noted that analogous application of § 6(1a) VermG to singular restitution claims is already settled, but the present case raises whether and how that approach extends to situations where quorum is lacking, including who counts as entitled persons.
