Sintesi Omnilex

The Federal Administrative Court upheld the complainants' complaint against the refusal to admit revision. It found that the case has fundamental significance because revision must clarify whether supervisory board members of a municipality-participated GmbH, elected on the municipality's proposal, may be subject to instructions and whether such instruction-binding is compatible with company law, in particular Section 52 GmbHG.
