The Federal Administrative Court upheld the plaintiff’s complaint against non-admission of revision. It held that the case raises a question of fundamental significance: whether, after expiry of the defect-remedy period under § 105(5) AMG, a pharmaceutical company may still rely on a marketing authorization granted in another EU Member State under § 105(4c) AMG to obtain extension of the fictitious authorization. The court emphasized the issue’s broader relevance for pending and future re-registration proceedings. It also provisionally set the dispute value for the revision proceedings.

§ 132 Abs. 2 Nr. 1 VwGO; fundamental significance of a question in non-admission complaint proceedings: Revision is to be allowed where the proceedings can clarify a legal question of fall-overriding importance that is likely to arise in a number of cases and remains unresolved. Such significance exists in particular where the answer is relevant for pending and future cases of a comparable kind. In pharmaceutical re-registration matters, the question whether, after expiry of the defect-remedy period under § 105(5) AMG, reliance may still be placed on an authorization obtained in another EU Member State under § 105(4c) AMG is capable of meeting this threshold.

Titelzeile
