Sintesi Omnilex

The Federal Administrative Court upheld the plaintiff’s complaint and admitted revision under Section 132(2)(1) VwGO. It considered the case of fundamental importance because revision could clarify whether jurisdictional provisions may be raised as reviewable objections in an environmental association action against a planning approval decision. The court also fixed the value in dispute for the complaint and revision proceedings.

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility on grounds of fundamental importance in an environmental association action against a planning approval decision: fundamental importance exists where the proposed revision is apt to clarify a previously unresolved legal question capable of general significance. Whether jurisdictional provisions are rügefähig in such proceedings is a question suitable for clarification in revision. The required abstract legal need for clarification is sufficient; the court need not already decide the substantive question in the admissibility stage (consid. 1).
