The Federal Administrative Court treated the complainant’s renewed submission against its earlier order as a hearing complaint. It held the complaint inadmissible because the filing did not show any violation of the right to be heard within the meaning of Section 152a VwGO. The complainant’s references to constitutional and other case law did not address the ground on which the prior appeal had been dismissed as inadmissible. Costs were imposed on the complainant, while court fees were waived for the complaint proceedings.

Massima Omnilex

§ 152a VwGO; hearing complaint inadmissible absent a substantiated violation of the right to be heard. A hearing complaint is only admissible where the applicant plausibly demonstrates that the court failed to consider essential submissions or otherwise infringed the constitutional procedural guarantee of hearing. Mere disagreement with the legal assessment, repetition of arguments, or citation of general constitutional and case-law authorities does not suffice if it does not engage with the actual reasoning of the challenged decision (consid. 2). Costs follow § 154 Abs. 2 VwGO; court fees may be omitted by analogous application of § 21 Abs. 1 sentence 3 GKG.

Dokumenttyp: Beschluss

Vorinstanz: vorgehend Oberverwaltungsgericht Berlin-Brandenburg, 23. Juni 2016, Az: OVG 6 M 37.16, Beschlussvorgehend VG Berlin, 22. Februar 2016, Az: 26 K 115.15

Spruchkörper: 1. Senat

Gründe
