The Federal Administrative Court granted leave to appeal in a dispute concerning working time in the fire service. It held that the case raises a question of fundamental importance: what requirements an EU-law opt-out rule must meet when volunteers perform shift work exceeding 48 hours per week under Article 22(1) of Directive 2003/88/EC. The court considered revision proceedings suitable for clarifying that question.

§ 132 Abs. 2 Nr. 1 VwGO; Art. 22 Abs. 1 RL 2003/88/EG; admission of revision for fundamental importance: A complaint is well founded where the challenged judgment raises a legally unresolved and clarifiable question on the requirements of a member-state opt-out arrangement permitting voluntary overtime in fire service shift work beyond 48 weekly hours. A revision is to be admitted if the case is suitable to contribute to the clarification of that question in the interests of uniform development of the law.
