Sintesi Omnilex

In an asylum case, the Federal Administrative Court granted the plaintiffs' complaint and admitted the revision. The Court found fundamental legal significance because the case may clarify the relationship between Section 26a AsylG and Section 27a AsylG. Other asserted grounds for leave, including the alleged divergence, were not decisive.

Massima Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental legal significance requires a question of law capable of clarification in the concrete case and of importance beyond the individual dispute. If such significance is established, other asserted grounds need not be examined further. The potential relationship between Section 26a AsylG and Section 27a AsylG can constitute such a clarifiable question where its interpretation is decisive for the outcome (consid. 2).
