The Federal Administrative Court granted the complaint seeking leave to appeal. It held that the case raises an unresolved question of fundamental importance: whether a reimbursement claim under § 49a(1) VwVfG in conjunction with Rhineland-Palatinate administrative procedure law is subject to limitation and, if so, under what conditions limitation occurs. The Court emphasized that the question has not yet been clarified in its case law and is relevant in many cases.

Massima Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; leave to appeal for fundamental importance; a complaint is successful where it identifies an unresolved, revisable legal question capable of clarification in revision and of relevance beyond the individual case. The contested question whether a reimbursement claim under § 49a Abs. 1 VwVfG in conjunction with § 1 LVwVfG RP is subject to limitation, and what requirements govern the commencement or occurrence of limitation, was previously unsettled in the case law of the Federal Administrative Court and therefore warranted revision (consid. 1).
