Sintesi Omnilex

The Federal Administrative Court upheld the defendant's complaint and admitted the revision. It held that the case has fundamental significance because it may clarify whether, after an unlawful inadmissibility rejection of an asylum application under § 27a AsylVfG, judicial protection must be sought by an annulment action or by an action seeking refugee recognition. The Court therefore did not need to examine the further grounds for leave.

§ 132 Abs. 2 Nr. 1 VwGO; asylum procedure; legal remedy against unlawful inadmissibility rejection under § 27a AsylVfG. Revision is to be admitted where the appeal raises a question of fundamental significance requiring clarification in revisional proceedings. In cases of an allegedly unlawful inadmissibility rejection of an asylum application, the unresolved allocation between annulment action and action seeking refugee recognition may justify leave to appeal if the question is decisive for the choice of the proper judicial remedy (consid. 2).
