Leitsatz

NV: Eine angeblich nicht hinreichend gewährte Akteneinsicht kann die Revisionszulassung nicht rechtfertigen. Vielmehr ist gegen eine Verweigerung oder nicht hinreichende Gewährung der Akteneinsicht seitens des FG Erinnerung und Beschwerde gemäß §§ 133, 128 Abs. 1 FGO gegeben.

Gründe

1 Die Beschwerde hat keinen Erfolg.

2 Das Finanzgericht (FG) hat nicht verfahrensfehlerhaft gehandelt (§ 115 Abs. 2 Nr. 3 i.V.m. § 76 Abs. 2 der Finanzgerichtsordnung --FGO--). Abgesehen davon, dass die fachkundig vertretene Klägerin und Beschwerdeführerin (Klägerin) ihren schriftsätzlich gestellten Beweisantrag zur Einholung eines Sachverständigengutachtens über die Höhe der Baukosten in der mündlichen Verhandlung nicht wiederholt und sie mithin auf die Beweiserhebung verzichtet hat (§ 155 FGO i.V.m. § 295 der Zivilprozessordnung), wäre ein solcher Beweis unter Zugrundelegung der maßgeblichen Rechtsauffassung des FG nicht geeignet festzustellen, in welcher Höhe tatsächlich im Einzelfall Aufwendungen getätigt worden sind.

3 Soweit sich die Nichtzulassungsbeschwerde auf eine nicht ausreichend gewährte Akteneinsicht beruft, ist das behauptete finanzgerichtliche Verbot, Kopien aus der Akte zu fertigen, schon nicht substantiiert behauptet und auch nicht ersichtlich. Zudem hätte die Klägerin gegen ein solches Verbot selbst im Wege der Erinnerung (§ 133 FGO) vorgehen können, zusätzlich wäre gegen die entsprechende Entscheidung des FG die Beschwerde gegeben gewesen (§ 128 Abs. 1 FGO).

4 Von einer weiteren Begründung wird gemäß § 116 Abs. 5 Satz 2 2. Halbsatz FGO abgesehen.
