Gründe

1 Die Nichtzulassungsbeschwerde ist unbegründet. Die vom Kläger und Beschwerdeführer gerügten Verfahrensmängel (§ 115 Abs. 2 Nr. 3 der Finanzgerichtsordnung --FGO--) wurden nicht dargelegt i.S. von § 116 Abs. 3 Satz 3 FGO oder liegen nicht vor.

Macht ein Beschwerdeführer den Verfahrensmangel einer überlangen Verfahrensdauer geltend, so sind Ausführungen dazu erforderlich, inwieweit das angefochtene Urteil anders ausgefallen wäre, wenn das Finanzgericht (FG) zu einem früheren Zeitpunkt entschieden hätte (Beschluss des Bundesfinanzhofs --BFH-- vom 26. September 2007 VII B 75/07, BFH/NV 2008, 126). Hieran fehlt es im Streitfall.

3 2. Auch die Rüge, das FG habe die Klage zu Unrecht als unzulässig verworfen, führt nicht zur Zulassung der Revision.

4 Zwar ist nach ständiger Rechtsprechung des BFH ein Verfahrensmangel i.S. des § 115 Abs. 2 Nr. 3 FGO anzunehmen, wenn das FG rechtsfehlerhaft durch Prozess- anstatt durch Sachurteil entscheidet und dadurch auch den Anspruch auf rechtliches Gehör verletzt (vgl. BFH-Beschlüsse vom 17. Januar 2002 VI B 114/01, BFHE 198, 1, BStBl II 2002, 306, und vom 16. April 2007 VII B 98/04, BFH/NV 2007, 1345). Ein solcher Verfahrensmangel ist hier jedoch nicht festzustellen. Das FG hat zutreffend insoweit einen Wegfall des Rechtsschutzinteresses (§ 40 Abs. 2 FGO) angenommen, als die Vertreterin der Beklagten und Beschwerdegegnerin in der mündlichen Verhandlung vor dem FG einen Abhilfebescheid zugesagt hatte (s. Brandt in Beermann/ Gosch, FGO § 138 Rz 50, Stichwort "Zusage einer Bescheidänderung").
