The Federal Constitutional Court did not accept the constitutional complaint for decision. It held that the complaint was inadmissible because the complainant had not exhausted the available administrative judicial remedies against the City B. certification dated 2004-04-20. The Court therefore abstained from giving any further reasoning under § 93d Abs. 1 sentence 3 BVerfGG.
§ 93d Abs. 1 Satz 3 BVerfGG; constitutional complaint inadmissible for failure to exhaust remedies. A constitutional complaint is inadmissible where the complainant has not first pursued the available ordinary legal remedies, here the administrative court remedy against a municipal certification issued under the Investitionszulagengesetz 1999. The subsidiarity requirement applies irrespective of the merits of the asserted constitutional objections. If the prerequisite of exhaustion is missing, the Court may decline to admit the complaint without further reasoning.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen, weil sie mangels Ausschöpfung des verwaltungsgerichtlichen Rechtsweges gegen die Bescheinigung der Stadt B. vom 20. April 2004 gemäß § 6 Abs. 1 Satz 3 Alternative 2 des Investitionszulagengesetzes 1999 unzulässig ist.
Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
