The Federal Constitutional Court did not admit the constitutional complaint because it was filed out of time. The complainant had tried to keep the deadline open by filing a hearing complaint, but this remedy was manifestly inadmissible and therefore ineffective for the deadline. In addition, the Court imposed an abuse fee of EUR 500 on the complainant's lawyer because the complaint used insulting and demeaning language toward judges and court staff.

§ 93 Abs. 1 Satz 1 BVerfGG; § 34 Abs. 2 BVerfGG; inadmissibility of a constitutional complaint filed out of time and abuse fee for insulting submissions. A hearing complaint that is manifestly inadmissible does not belong to the effective legal remedies and cannot keep the filing period for a constitutional complaint open. A misuse of constitutional complaint proceedings exists where the submission, in its external form, is insulting, degrading, or otherwise clearly lacks objectivity toward judges or court staff; in such cases an abuse fee may be imposed on counsel (consid. 1-3).

Questione giuridica chiave

Whether the constitutional complaint was admissible despite the expired one-month deadline.

Decisione estratta

No. The complaint was inadmissible because the one-month period was not complied with; an obviously inadmissible hearing complaint did not keep the deadline open.

Motivazione estratta

The court held that the hearing complaint, being manifestly inadmissible, was not part of the legal remedy chain and therefore could not suspend or extend the filing deadline for the constitutional complaint.

Questione giuridica chiave

Whether an abuse fee should be imposed on the complainant's lawyer for the manner of filing the complaint.

Decisione estratta

Yes. A misuse of constitutional complaint proceedings was found because the filing was insulting, degrading, and entirely lacking in sobriety.

Motivazione estratta

A misuse exists where a constitutional complaint in its outward form has an insulting or injurious character and lacks any factual sobriety; the lawyer's remarks about judges and staff of the ordinary courts and the Constitutional Court met that standard.
