Sintesi Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant was obviously not injured in her fundamental rights by the Bayreuth District Court orders refusing renewed legal aid advice, because those orders merely reflected the view that the already granted legal aid for reviewing her old-age pension also covered the objection proceedings. Since the challenged decisions did not burden her but instead confirmed the legal aid she sought, the complaint was inadmissible. No further reasons were given under § 93d(1) sentence 3 BVerfGG.

Massima Omnilex

§ 90 BVerfGG; constitutional complaint inadmissible where the challenged decision cannot obviously infringe the complainant’s fundamental rights; an order refusing a renewed application for legal aid advice is not a burden if it merely confirms that the already granted legal aid also extends to the intended objection proceedings. In such a case there is no present infringement by the challenged decision, and the complaint is not admitted; further reasoning may be omitted under § 93d(1) sentence 3 BVerfGG.

Titelzeile

Questione giuridica chiave

Whether the constitutional complaint was admissible despite the challenged orders allegedly confirming the complainant's view on legal aid.

Decisione estratta

No. The complaint was inadmissible because the complainant could obviously not be violated in her fundamental rights by the challenged orders.

Motivazione estratta

The District Court refused the renewed application because, in its view, the already granted legal aid for reviewing the old-age pension also covered the objection proceedings. The challenged orders therefore did not burden the complainant; they confirmed that the desired legal aid had already been granted.
