The complainant challenged Federal Administrative Court decisions concerning the allocation of costs for connection points under § 13 AEG. The Federal Constitutional Court held that the complaint did not meet the admission requirements of § 93a BVerfGG because it raised no fundamental constitutional question and had no sufficient prospect of success. It further held that the Federal Administrative Court neither interpreted § 13 AEG in an objectively arbitrary way nor exceeded the limits of permissible judicial development of the law. The constitutional complaint was therefore not admitted.

The Federal Constitutional Court admits a constitutional complaint only where it raises a fundamental constitutional question or is necessary to enforce constitutional rights. A challenged interpretation of ordinary law violates Art. 3(1) GG only if it is objectively arbitrary. Under Art. 20(3) GG in conjunction with Art. 2(1) GG, judicial interpretation must remain bound by statute and may not amount to impermissible judicial law-making; mere disagreement with the ordinary-law construction is insufficient.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.
1 Die Beschwerdeführerin wendet sich gegen die Auferlegung von Kosten für Anschlussweichen auf Grundlage des § 13 AEG. Die Verfassungsbeschwerde betrifft die Frage, in welchem Verhältnis ein anschlussgewährendes Eisenbahnunternehmen und ein anschlussnehmendes Eisenbahnunternehmen die Anschlusskosten nach § 13 AEG zu tragen haben.
2 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil die Voraussetzungen des § 93a Abs. 2 BVerfGG nicht vorliegen.
3 Der Verfassungsbeschwerde kommt keine grundsätzliche verfassungsrechtliche Bedeutung zu. Die Annahme der Verfassungsbeschwerde ist auch nicht zur Durchsetzung der als verletzt bezeichneten Grundrechte angezeigt (§ 93a Abs. 2 Buchstabe b BVerfGG), weil die Verfassungsbeschwerde keine hinreichende Aussicht auf Erfolg hat (vgl. BVerfGE 90, 22 <26>; 96, 245 <250>; 108, 129 <136>; stRspr). Sie ist jedenfalls unbegründet.
4 Das Bundesverwaltungsgericht hat § 13 AEG nicht in objektiv willkürlicher Weise fehlerhaft (Art. 3 Abs. 1 GG) ausgelegt und angewendet. Zudem wahrt die Auslegung, die die Vorschrift durch das Bundesverwaltungsgericht gefunden hat, die richterliche Bindung an Recht und Gesetz und stellt keine unzulässige Rechtsfortbildung (Art. 20 Abs. 3 GG i.V.m. Art. 2 Abs. 1 GG) dar.
5 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
6 Diese Entscheidung ist unanfechtbar.
