Die Verfassungsbeschwerden werden nicht zur Entscheidung angenommen.

Gründe

1 Die Verfassungsbeschwerden werden nicht zur Entscheidung angenommen, weil die Voraussetzungen des § 93a Abs. 2 BVerfGG nicht vorliegen. Ihnen kommt keine grundsätzliche verfassungsrechtliche Bedeutung zu. Die für die Entscheidung maßgeblichen verfassungsrechtlichen Fragen sind geklärt. Die Annahme der Verfassungsbeschwerden ist auch nicht gemäß § 93a Abs. 2 Buchstabe b BVerfGG zur Durchsetzung der in § 90 Abs. 1 BVerfGG genannten Rechte angezeigt.

2 Die selbständig tragende Annahme der Fachgerichte, ein Verschulden der zuständigen Amtsträger im Hinblick auf möglicherweise menschenunwürdige Haftbedingungen der Beschwerdeführer sei nicht gegeben, folgt höchstrichterlichen Maßstäben (vgl. BGHZ 198, 1 <4 f.>) und liegt im Rahmen des fachgerichtlichen Wertungsspielraums. Zu dem damaligen, hier entscheidungserheblichen Zeitpunkt war in der obergerichtlichen Rechtsprechung ungeklärt und auch sonst nicht hinreichend deutlich, inwieweit die streitigen Haftbedingungen mit der Garantie der Menschenwürde unvereinbar seien. Auch soweit sich der Beschluss des Oberlandesgerichts im Verfahren 1 BvR 1639/15 nicht mit dem Verschulden befasst ist aus der Entscheidung der Vorinstanz deutlich abzusehen, dass dem Beschwerdeführer im Falle einer Zurückverweisung aus demselben Grund im Ergebnis der Erfolg versagt bliebe (vgl. BVerfGE 90, 22 <25 f.>).

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
