The Federal Constitutional Court did not admit a constitutional complaint against a social court judgment and the Bavarian Higher Social Court’s decision. It held that the complaint failed the subsidiarity requirement because the complainant did not show that he had pursued an Anhörungsrüge under Section 178a SGG. That remedy could have allowed the social courts to review the alleged omission of his submissions and medical documents. The Court therefore declined to give further reasons and stated that the decision is not subject to appeal.
Art. 90 Abs. 2 BVerfGG; § 178a Abs. 1 S. 1 SGG; subsidiarity of the constitutional complaint when an Anhörungsrüge has not been filed: A constitutional complaint is inadmissible if the complainant has not first used the statutory remedy available to remedy an alleged violation of the right to be heard. The Anhörungsrüge must be exhausted where the asserted defect is that the court failed to consider submissions or evidence; it enables the Fachgericht to rectify the alleged hearing violation itself (consid. 1).

Nichtannahmebeschluss: Subsidiarität der Verfassungsbeschwerde bei unterlassener Anhörungsrüge (hier: gem § 178a SGG)
Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.
1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen (§ 93a Abs. 2 BVerfGG). Sie wahrt nicht den Grundsatz der Subsidiarität. Der Beschwerdeführer hat nicht vorgetragen, dass er gegen den Beschluss des Landessozialgerichts eine Anhörungsrüge nach § 178a SGG erhoben hat. Dieser Rechtsbehelf hätte schon im fachgerichtlichen Verfahren die Prüfung der Rüge ermöglicht, das Landessozialgericht habe ebenso wie das Sozialgericht den Vortrag und die vorgelegten Unterlagen zum Gesundheitszustand des Beschwerdeführers nicht gewürdigt.
2 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
