The First Senate’s Third Chamber of the Federal Constitutional Court rejected as inadmissible the complainant’s recusal motions against Vice President Kirchhof, Judge Masing, and Judge Baer, finding them abusive. It then did not admit the constitutional complaint for decision. The chamber dispensed with any further reasoning under § 93d(1) sentence 3 BVerfGG.
§ 93d Abs. 1 Satz 3 BVerfGG; missbräuchliches Ablehnungsgesuch im verfassungsgerichtlichen Verfahren; a plainly abusive recusal motion against members of the chamber is inadmissible and may be disposed of summarily without further reasoning. The court may likewise refrain from a fuller statement of reasons when it does not admit the constitutional complaint for decision.
