The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant had failed to file an Anhörungsrüge before lodging the complaint, so the complaint was inadmissible under § 90(2) BVerfGG. The Chamber additionally noted, without deciding the case on that point, that prison authorities may have to forward inmate applications promptly, including by fax, to secure effective access to court under Art. 19(4) GG. The decision is final.

Massima Omnilex

§ 90 Abs. 2 S. 1 BVerfGG; constitutional complaint inadmissible for failure to exhaust the hearing objection (Anhörungsrüge); an asserted violation of Art. 103 Abs. 1 GG by the appellate court does not dispense with the subsidiarity requirement. A complaint raising an independent denial-of-hearing claim remains subject to prior use of the procedural remedy designed to cure such a defect. By way of obiter dictum, effective judicial protection under Art. 19 Abs. 4 S. 1 GG may require prison authorities to forward inmate applications to the court without delay, including by telecommunication, where otherwise timely access to court would be jeopardized.

Titelzeile
