Gründe

1 Die angegriffene Verurteilung gemäß § 140 StGB bewegt sich im Ergebnis im fachgerichtlichen Wertungsrahmen. Gegenstand der angegriffenen Entscheidungen sind Plakate, die Straftaten abbilden und mit der Aufforderung "abwerten!" überschrieben sind. Diese haben appellativen Charakter und sind geeignet, den öffentlichen Frieden zu stören, da sie bei den Angesprochenen Handlungsbereitschaft auslösen oder Hemmschwellen herabsetzen können. Die Verurteilung dient damit, wie nach Art. 5 Abs. 1 GG geboten, dem Schutz der Rechte Dritter und der Gewährleistung von Friedlichkeit, nicht aber lediglich einem Schutz vor allgemeiner Beunruhigung (vgl. BVerfGE 124, 300 <335>).

2 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
