Sintesi Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. Although it voiced doubts about the compatibility of the social-law remedy structure with effective judicial protection and about the application of the benefit-exclusion rules to a student, it held that the complaint lacked a continuing legal interest after the complainant had finished school. No repetition risk existed, so the case was not examined on the merits.

Massima Omnilex

Art. 19 Abs. 4 GG, § 90 BVerfGG; constitutional complaint after loss of original burden: legal interest in a decision survives only exceptionally. After the challenged measure has ceased, admissibility requires either that a constitutional question of fundamental importance would otherwise remain unresolved or that a concrete risk of repetition justifies declaratory review (consid. 2). Absent such circumstances, especially where the factual situation has changed irreversibly, the complaint is inadmissible. The Court may then refrain from further reasoning under § 93d Abs. 1 Satz 3 BVerfGG.

Titelzeile

Questione giuridica chiave

Whether the constitutional complaint remained admissible after the complained-of burden had ceased to exist.

Decisione estratta

The complaint was not admissible because the complainant no longer had a sufficient legal interest in a decision.

Motivazione estratta

A legal interest after loss of standing persists only in exceptional cases, especially where a question of fundamental constitutional importance would otherwise remain unresolved or where there is a risk of repetition. Those conditions were absent because no repetition risk existed once school had ended.

Questione giuridica chiave

Whether the refusal of urgent judicial protection under social-law rules raised a constitutional concern requiring review on the merits.

Decisione estratta

The Court expressed doubts about the compatibility of the remedy structure with the right to effective legal protection, but did not examine the complaint on the merits due to inadmissibility.

Motivazione estratta

The Court noted possible concerns about referring the complainant to later review against a future benefit withdrawal and also questioned the application of the relevant rules to a student, but this did not overcome the missing legal interest.
