Gründe

1 Die Verfassungsbeschwerde wird gemäß § 93a BVerfGG nicht zur Entscheidung angenommen. Sie hat keine Aussicht auf Erfolg, weil die angegriffene Entscheidung des Bundesgerichtshofs, wonach weder § 1763 Abs. 1 BGB noch § 1771 Satz 1 BGB die Aufhebung einer Minderjährigenadoption nach Eintritt der Volljährigkeit der angenommenen Person zulassen, verfassungsrechtlich nicht zu beanstanden ist. Dies gilt auch für die Einschätzung des Bundesgerichtshofs, dass diese Rechtslage mit dem Grundgesetz vereinbar ist.

2 Die Kammer verkennt nicht, dass die Beschwerdeführerin in ihren Grundrechten betroffen ist. Die familienrechtliche Zuordnung im Rahmen eines Eltern-Kind-Verhältnisses mag für das Verständnis und die Entfaltung der eigenen Individualität in bestimmten Situationen ähnliche Bedeutung gewinnen wie etwa die biologische Abstammung (vgl. BVerfGE 79, 256 <268 f.>), der Personenstand (vgl. BVerfGE 128, 109 <124 m.w.N.>) oder auch der rechtlich zugewiesene Name (vgl. BVerfGE 78, 38 <49>). Sofern mit der Unaufhebbarkeit der Annahme Belastungen für die Angenommenen verbunden sind, werden diese durch die Möglichkeit der Durchtrennung des namensrechtlichen Bandes (§ 3 NamÄndG) sowie der Abwehr unerwünschter unterhaltsrechtlicher (§ 1611 BGB) und erbrechtlicher (§ 2339 BGB) Folgen gemildert.

3 Dass der Gesetzgeber nicht darüber hinaus auch die Aufhebung der Adoption minderjährig Angenommener nach Eintritt der Volljährigkeit vorgesehen hat, liegt noch im Gestaltungsspielraum, welcher dem Gesetzgeber bei der rechtlichen Ausgestaltung der Familie zukommt (vgl. BVerfGE 133, 59 <84 f.>). Der Gesetzgeber hat bei dieser Ausgestaltung des Adoptionsrechts konsequent die verfassungsrechtlich legitime Zielsetzung verfolgt, die dauerhafte Integration angenommener Kinder in die aufnehmende Familie durch vollständige Angleichung des rechtlichen Status leiblicher und angenommener Kinder zu fördern (BTDrucks 7/3061, S. 1). Von einer Durchbrechung dieser Gleichstellung hat er auch hinsichtlich der Aufhebbarkeit des Eltern-Kind-Verhältnisses gezielt abgesehen (a.a.O., S. 27). Dass demgegenüber eine Volljährigenadoption aufgelöst werden kann, wenn sie nicht mit den Wirkungen der Minderjährigenadoption erfolgte (§ 1771 Satz 1 BGB), ist konsequent, weil die oder der Angenommene hier wegen der schwachen Adoptionswirkungen von vornherein rechtlich nicht in gleichem Maße in die Familie aufgenommen wird wie bei der Minderjährigenadoption. Plausibel ist auch, dass die Adoption Minderjähriger in besonderen Situationen aufgelöst werden kann, solange die oder der Angenommene minderjährig ist (§ 1763 Abs. 1 BGB), weil angesichts der Unzulässigkeit einer sogenannten Kettenadoption (§ 1742 BGB) nur so die Möglichkeit besteht, dass das minderjährige Kind, das der elterlichen Pflege und Erziehung bedarf, durch erneute Adoption geeignete Eltern erhält.

4 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

5 Diese Entscheidung ist unanfechtbar.
