The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant had not sufficiently shown compliance with the filing and reasoning deadlines or proper exhaustion of remedies. The request for reinstatement into the one-month deadline was rejected because illness was not substantiated as the cause of the missed deadline. The court therefore declined to give further reasons and the decision is final.

§ 23 Abs. 1 S. 2, § 92, § 93 Abs. 1 S. 1, § 93 Abs. 2 S. 1 BVerfGG; reinstatement into the constitutional complaint deadline on account of illness requires substantiated causal incapacity to file or instruct counsel. Illness may justify reinstatement only if the complainant demonstrates, with sufficient particulars, that it prevented timely lodgement or substantiation of the complaint, either personally or through a representative. If the nature and severity of the illness are not described and are not otherwise evident, the causal link is not established and reinstatement must be refused (consid. 3). A constitutional complaint is inadmissible where compliance with the deadline and exhaustion of remedies is not adequately pleaded.

Titelzeile

No. The complaint was inadmissible because compliance with the deadline and proper exhaustion of remedies were not sufficiently substantiated.

The complaint did not satisfy the pleading requirements; the court could not verify timely filing or exhaustion of remedies from the submissions.

Questione giuridica chiave

Whether the complainant was entitled to reinstatement into the one-month constitutional complaint deadline because of illness.

Decisione estratta

No. Reinstatement was refused because no sufficient reinstatement ground was shown; illness can justify reinstatement only if it actually prevented filing or substantiation, which was not demonstrated.

Motivazione estratta

The nature and severity of the illness were not explained and were not self-evident, so causation between the illness and the missed deadline could not be assessed.
