The Federal Constitutional Court did not accept the constitutional complaint for decision. It held that the complaint was inadmissible because the complainant had not exhausted available BAföG remedies and had not shown any application for BAföG benefits or a challenge to their refusal. In addition, the complaint did not meet the statutory substantiation requirements. The Court therefore declined to provide further reasoning and stated that the decision is not appealable.

§ 90 Abs. 2 S. 1, § 23 Abs. 1 S. 2, § 92 BVerfGG; admissibility of a constitutional complaint against the student-benefit exclusion under § 7 Abs. 5 SGB II requires prior exhaustion of available BAföG procedures where the complaint concerns the legality of study-funding limits. The subsidiarity principle bars direct constitutional review if the complainant has not shown use of the ordinary legal remedies or even an application for BAföG benefits. Independently, the complaint must substantiate a possible violation of fundamental rights in a comprehensible manner; a merely conclusory submission does not satisfy the pleading requirements. Where these prerequisites are missing, the complaint is not accepted for decision (consid. 2-3).

Titelzeile
