Sintesi Omnilex

The Federal Constitutional Court did not admit a constitutional complaint against the execution of coercive treatment under Berlin mental health law. It held that the complainant had not shown exhaustion of remedies, because an application for judicial decision before the competent Amtsgericht was available under § 327(1) FamFG. As the complaint was not admitted, the request for interim relief was also moot. The decision is final and not appealable.

Massima Omnilex

§ 90 Abs. 2 BVerfGG; constitutional complaint against concrete coercive-treatment measures under § 30 Abs. 2 sentence 2 PsychKG BE is inadmissible absent exhaustion of legal remedies. Before seizing the Federal Constitutional Court, the complainant must first pursue the statutory application for judicial decision under § 327 Abs. 1 FamFG before the competent Amtsgericht. It is sufficient that such a remedy is available and appropriate for review of the challenged measure; a direct constitutional complaint is excluded if the ordinary judicial route has not been shown to have been taken (consid. 2). If the complaint is not admitted, an application for interim relief loses its object.

Titelzeile

Nichtannahmebeschluss: Mangels Rechtswegerschöpfung unzulässige Verfassungsbeschwerde gegen die Durchführung einer Zwangsbehandlung nach § 30 Abs 2 S 2 PsychKG BE

Gründe

Questione giuridica chiave

Whether the request for interim relief should be decided separately.

Decisione estratta

The request for interim relief became moot once the complaint was not admitted.

Motivazione estratta

Because the constitutional complaint was not accepted for decision, there was no basis for the requested interim order.
