In a constitutional complaint proceeding, the Federal Constitutional Court repeated its earlier interim order of 2012-08-29. The order continues the suspension of the granting of contact visits in order to preserve the status quo pending the main constitutional review, given the asserted risk of attacks by right-wing extremists against the children and their mother. The repetition applies until 2013-01-31, or earlier if the constitutional complaint is decided.
Art. 32 Abs. 1, Abs. 6 S. 2 BVerfGG; repetition of an interim order; interim protection may be renewed where the reasons for provisional relief continue. In proceedings concerning contact arrangements under family law, the Constitutional Court may maintain the status quo by repeating a prior order if this is necessary to avert serious disadvantages pending the decision on the constitutional complaint. The temporal limitation must be set so that the provisional measure remains strictly accessory to the main proceedings (consid. unspecified).
