Sintesi Omnilex

The Federal Constitutional Court did not admit the constitutional complaint because the complainant failed to plausibly show compliance with the deadline under § 93(1) sentence 1 BVerfGG. The Court considered the asserted notification date impossible in light of the dated power of attorney, the registry dispatch note, and file copies showing earlier notification. Because the procedural representative did not adequately respond to the Court's warning, the Court also imposed a misuse fee of EUR 1,000 on counsel. The decision is final.

§ 93 Abs. 1 S. 1 BVerfGG, § 34 Abs. 2 BVerfGG; substantiation of compliance with the time limit and misuse fee for knowingly false or contradictory submissions. A constitutional complaint is inadmissible if the complainant does not sufficiently substantiate observance of the filing deadline. Where the asserted notification date is contradicted by objective file evidence and the party does not dispel the inconsistencies after judicial notice, the complaint may be rejected as inadmissible. Deliberately inaccurate or grossly inconsistent assertions concerning a decisive procedural circumstance may justify the imposition of a misuse fee on the counsel or representative (cf. consid. on abuse).

Vorinstanz: vorgehend OLG München, 9. Mai 2012, Az: 3 Ws 404 405/12, Beschluss

Spruchkörper: 2. Senat 3. Kammer

Titelzeile

Juli 2012 - 2 BvR 1142/12 -, juris).

Diese Entscheidung ist unanfechtbar.

Questione giuridica chiave

Whether the constitutional complaint sufficiently showed compliance with the time limit under § 93(1) sentence 1 BVerfGG

Decisione estratta

No. The alleged date of notification was contradicted by the power of attorney, the court registry dispatch note, and copies in the file; the complainant did not adequately address these inconsistencies.

Motivazione estratta

The complaint stated service only on 2012-06-14, but the signed power of attorney was dated 2012-06-04 and already identified the challenged order by date and docket number; the registry note indicated dispatch on 2012-05-11; other file copies showed notification on 2012-05-16.

Questione giuridica chiave

Whether a misuse fee should be imposed on the complainant's counsel

Decisione estratta

Yes. A misuse fee of EUR 1,000 was imposed on the complainant's procedural representative because the filing contained false statements about a decisive circumstance and those contradictions were not adequately explained after the Court's warning.

Motivazione estratta

Submitting inconsistent and evidently incorrect information on the notification date justified a misuse sanction under § 34(2) BVerfGG.
