Sintesi Omnilex

The Federal Constitutional Court granted legal aid without instalments and appointed Attorney S. only for complainant 1 in the constitutional complaint proceedings. The parallel application by complainant 2 was rejected because the complaint had no sufficient prospect of success. In addition, the constitutional complaint of complainant 2 was not accepted for decision as unfounded; further reasoning was omitted under § 93d(1) sentence 3 BVerfGG. The decision is final.

§ 22 Abs. 1 S. 1 BVerfGG, § 114 S. 1 ZPO, § 121 Abs. 2 ZPO; legal aid and appointment of counsel in constitutional complaint proceedings are to be granted only if the intended complaint offers sufficient prospects of success. Where this requirement is satisfied only for one of several complainants, legal aid may be limited accordingly. If the complaint is manifestly unfounded or otherwise lacks sufficient prospects, the application must be refused; the Court may refrain from further reasoning under § 93d(1) sentence 3 BVerfGG.
