Gründe

1 Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen, weil die Annahmevoraussetzungen des § 93a Abs. 2 BVerfGG nicht vorliegen. Der Verfassungsbeschwerde kommt keine grundsätzliche verfassungsrechtliche Bedeutung zu, denn die verfassungsrechtliche Zulässigkeit der Erbersatzsteuer für Familienstiftungen als solche ist geklärt (vgl. BVerfGE 63, 312).

2 Ihre Annahme ist auch nicht zur Durchsetzung der als verletzt gerügten Rechte angezeigt. Mit ihrer Verfassungsbeschwerde wendet sich die Beschwerdeführerin in erster Linie gegen die Auslegung und Anwendung des Erbschaftsteuerrechts und hier vor allem gegen die Bestimmung der Voraussetzungen einer Familienstiftung durch den Bundesfinanzhof. Im Rahmen der dem Bundesverfassungsgericht vorbehaltenen eingeschränkten Kontrolle der Auslegung und Anwendung des einfachen Rechts durch die Fachgerichte (vgl. BVerfGE 18, 85 <92 f.>; stRspr) lässt sich weder feststellen, dass der Bundesfinanzhof das Erbschaftsteuerrecht willkürlich ausgelegt (vgl. zu diesem Maßstab BVerfGE 87, 273 <278 f.>; 89, 1 <13 f.>), noch dass er dabei die Bedeutung der Grundrechte, insbesondere von Art. 2 Abs. 1 und Art. 14 Abs. 1 GG, grundlegend verkannt hat.

3 Das angegriffene Urteil des Bundesfinanzhofs stellt sich schon mit Rücksicht auf die Einlassungen des beklagten Finanzamts im Ausgangsverfahren nicht als eine gegen Art. 103 Abs. 1 GG verstoßende Überraschungsentscheidung dar.

4 Soweit die Beschwerdeführerin im Übrigen eine Verletzung der allgemeinen Handlungsfreiheit durch Nichtbeachtung des Stifterwillens, der Eigentumsfreiheit durch den Zugriff auf das Vermögen der Stiftung und des Art. 6 Abs. 1 GG wegen der Besteuerung unter Bezugnahme des Steuertatbestands auf die Familie sowie des Art. 3 Abs. 1 GG wegen Inländerdiskriminierung rügt, genügt sie nicht den Anforderungen von § 23 Abs. 1 Satz 2, § 92 BVerfGG an eine hinreichend substantiierte Begründung.

5 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

6 Diese Entscheidung ist unanfechtbar.
