The Federal Constitutional Court dismissed the election review complaint as inadmissible. The complaint had been filed without the statutory support of at least 100 eligible voters required by § 26(3) sentence 2 EuWG. No further issues were addressed.
§ 26 Abs. 3 S. 2 Alt. 2 EuWG; election review complaint inadmissible for lack of support by 100 eligible voters. The admissibility requirement that an election review complaint be joined by at least one hundred eligible voters is a strict procedural prerequisite. If this support is absent, the complaint must be rejected as inadmissible under § 48 Abs. 1 Alt. 2 BVerfGG without examination of the merits (consid. 1).
