The Federal Constitutional Court did not admit the constitutional complaint. It held that the challenge to the Cologne Regional Court decisions was time-barred because the complainant knew of the decisive order by 2010-09-08 at the latest, and a second hearing complaint could not keep the one-month filing period open because it was manifestly inadmissible. In addition, the alleged violation arising from the Regional Court's inactivity was not sufficiently substantiated. The Court dispensed with further reasoning and stated that the decision is not subject to appeal.

Massima Omnilex

§ 93 Abs. 1 Satz 1 BVerfGG; a manifestly inadmissible second hearing complaint does not suspend or reopen the one-month period for filing a constitutional complaint. A hearing complaint against the order rejecting a prior hearing complaint as unfounded is not provided for by simple law and is therefore manifestly inadmissible; it cannot preserve timeliness (consid. 3 b). Independently thereof, a constitutional complaint must substantiate the alleged violation of rights with the required specificity under §§ 23(1) sentence 2 and 92 BVerfGG; a bare allegation of judicial inactivity is insufficient (consid. 6).

Titelzeile

Questione giuridica chiave

Whether the constitutional complaint against the court decisions was filed within the one-month deadline.

Decisione estratta

No. The complaint was filed only on 2011-03-16, although the complainant knew of the relevant Regional Court order by 2010-09-08 at the latest; the deadline expired on 2010-10-08.

Motivazione estratta

A renewed hearing complaint cannot keep the constitutional complaint period open if it is manifestly inadmissible. The second hearing complaint against the order rejecting a hearing complaint as unfounded is simply unlawful and therefore does not suspend or restart the deadline.

Questione giuridica chiave

Whether the complaint sufficiently substantiated an alleged violation caused by the Regional Court's inactivity.

Decisione estratta

No. The asserted rights violation was not substantiated in the manner required by §§ 23(1) sentence 2 and 92 BVerfGG.

Motivazione estratta

Beyond the timeliness defect, the complainant failed to set out concretely and in a substantiated way how the Regional Court's inactivity violated her rights.
