The Second Senate of the Federal Constitutional Court dealt with joined proceedings challenging the ratification act for the 2004 Treaty establishing a Constitution for Europe. After that treaty was superseded by the Treaty of Lisbon, the proceedings were declared moot. The Court also denied reimbursement of the complainant’s expenses in the constitutional complaint proceedings and fixed the attorney’s object value at EUR 200,000 for the main case and EUR 20,000 for the interim injunction matter.
§ 37 Abs. 2 Satz 2 RVG; when fixing the object value for constitutional complaint proceedings and related interim relief, the Court determines the value according to the significance of the matter and may separately assess the main proceedings and the interim proceedings. If the challenged subject matter is superseded by later treaty law, the proceedings become moot. A request for reimbursement of expenses in constitutional complaint proceedings requires a specific legal basis and is otherwise to be rejected.

Die zur gemeinsamen Entscheidung verbundenen Verfahren haben sich mit der Ablösung des Vertrags über eine Verfassung für Europa vom 29. Oktober 2004 (Amtsblatt der Europäischen Union Nummer C 310/1) durch den Vertrag von Lissabon zur Änderung des Vertrags über die Europäische Union und des Vertrags zur Gründung der Europäischen Gemeinschaft vom 13. Dezember 2007 (Amtsblatt der Europäischen Union Nummer C 306/1) erledigt.
Der Antrag auf Erstattung der Auslagen des Beschwerdeführers in dem Verfahren zu II. wird abgelehnt.
Der Wert des Gegenstands der anwaltlichen Tätigkeit im Hauptsacheverfahren zu II. wird auf 200.000 € (in Worten: zweihunderttausend Euro) und in dem Verfahren auf Erlass einer einstweiligen Anordnung zu II. auf 20.000 € (in Worten: zwanzigtausend Euro) festgesetzt (§ 37 Abs. 2 Satz 2 RVG).
