The Federal Constitutional Court repeated its interim order of 8 December 2009 and again temporarily prohibited the deportation of an Eritrean applicant to Greece. The protection was limited to six months, but in any event only until the constitutional complaint is decided. The decision was declared non-appealable.
§ 32 Abs. 1, Abs. 6 S. 2 BVerfGG; repetition of an interim order pending constitutional complaint: An interim order may be renewed if provisional protection remains necessary to secure effective constitutional review. The court may limit the extension in time and tie it to the expected decision on the main proceedings, thereby preserving the status quo without prejudging the merits. The ancillary nature of interim relief permits repeated orders where the risk of irreparable disadvantages persists and the balance of consequences continues to favor maintenance of the provisional measure.

Die einstweilige Anordnung vom 8. Dezember 2009 wird für die Dauer von weiteren sechs Monaten, längstens bis zur Entscheidung über die Verfassungsbeschwerde, wiederholt.
Diese Entscheidung ist unanfechtbar.
