Gründe

1 Die Wahlprüfungsbeschwerde und der Antrag auf Erlass einer einstweiligen Anordnung sind aus den im Berichterstatterschreiben vom 21. Dezember 2009 mitgeteilten Gründen unzulässig.

2 Verfassungsrechtliche Bedenken gegen die Regelung in § 48 BVerfGG, wonach ein Wahlberechtigter nur dann Beschwerde gegen den Beschluss des Bundestages über die Gültigkeit einer Wahl erheben kann, wenn sein Einspruch vom Bundestag verworfen wurde, bestehen nicht. Dies folgt schon aus Art. 41 Abs. 1 Satz 1 GG, nach dem die Wahlprüfung Sache des Bundestages ist. Der Hinweis des Beschwerdeführers auf die potenzielle Dauer von Einspruchsverfahren vor dem Bundestag vermag daran nichts zu ändern.

3 Mangels hinreichender Aussicht auf Erfolg ist auch der Antrag auf Bewilligung von Prozesskostenhilfe und Beiordnung eines Rechtsanwalts abzulehnen (§ 114 Satz 1 ZPO analog).

4 Von einer weiteren Begründung wird gemäß § 24 Satz 2 BVerfGG abgesehen.
