Sintesi Omnilex

The Federal Constitutional Court refused to admit a constitutional complaint against a Federal Social Court judgment. It held that the complaint did not satisfy the substantiation requirements because it failed to engage with the reasoning of the challenged judgment and merely referred to a copy of another person's draft complaint, which was itself inadequate. The Court therefore found no sufficient prospects of success and dispensed with further reasons.

Massima Omnilex

§ 23 Abs. 1 S. 2, § 92 BVerfGG; substantiation requirements for constitutional complaints directed against judgments. A complainant must specifically identify the constitutional norms allegedly violated and make the possibility of a fundamental-rights violation apparent. Where the complaint challenges a judgment, it must engage with the impugned decision and its concrete reasoning. Mere reference to a third party’s draft constitutional complaint cannot substitute for this obligation, especially if that draft itself does not meet the statutory substantiation requirements (consid. 2-3).

Titelzeile

Questione giuridica chiave

Whether the constitutional complaint met the admissibility and substantiation requirements for acceptance.

Decisione estratta

The complaint was not accepted because it had no sufficient prospects of success; it was inadmissible for lack of substantiation.

Motivazione estratta

The complainant did not sufficiently explain which constitutional requirements were violated and did not address the reasoning of the challenged Federal Social Court judgment.

Questione giuridica chiave

Whether reference to a draft constitutional complaint of a third party could replace the required own reasoning.

Decisione estratta

No. Such a reference could not cure the lack of engagement with the challenged judgment, especially because the referenced draft was itself insufficiently substantiated.

Motivazione estratta

A complaint against a judgment requires specific engagement with that decision and its reasoning; mere incorporation by reference to a deficient third-party draft is inadequate.
