The BGH dismissed the defendant's revision against the LG Stendal judgment. Although the judgment did not state whether a fine from an earlier AG Magdeburg conviction had already been served, the Senate held that this omission caused no disadvantage because, even with a possible first total sentence and a second total sentence for the remaining offenses, the overall custodial penalty would not have been lower. The Court clarified the adhesion award to reflect the trial court's reasons: the defendant is liable for future material and immaterial damage. The defendant must bear the costs of the revision and the ancillary/adherence claimant's necessary expenses.

§ 55 Abs. 1 S. 1 StGB, § 349 Abs. 2 StPO; revision dismissed despite an omitted finding on the completion of an earlier sentence and possible Zäsurwirkung, where no prejudice to the defendant can arise because any lawful total-sentence formation would not have resulted in a lower overall penalty. The absence of a finding on the service status of an earlier fine prevents full review only in appearance; if, on the basis of the established sentencing framework, the defendant could not obtain a more favorable total punishment, the error is harmless (consid. not specified). An adhesion declaration may be clarified in the tenor to conform to the reasons, including future material and immaterial damages.

Revisionsverwerfung im Strafverfahren: Unterlassene Prüfung der Zäsurwirkung im Rahmen der Gesamtstrafenbildung

Tenor

Questione giuridica chiave

Whether the defendant's revision against the LG Stendal judgment was well-founded.

Decisione estratta

The revision was unfounded; the judgment showed no reversible error to the defendant's detriment.

Motivazione estratta

Review under § 349 Abs. 2 StPO disclosed no legal error affecting the defendant.

Questione giuridica chiave

Whether the missing finding on completion of a prior fine from AG Magdeburg required examination of a possible Zäsurwirkung and different total-sentence formation.

Decisione estratta

The court could not verify whether the prior fine had been served, but any error did not prejudice the defendant because both possible total-sentence configurations would still have led to the same or a more severe overall punishment.

Motivazione estratta

Even if a first aggregate sentence had to be formed, the minimum overall term would have been two years and seven months; the defendant therefore suffered no disadvantage from the omitted assessment.

Questione giuridica chiave

Whether the adhesion declaration had to be clarified as to the scope of future damages.

Decisione estratta

The declaration was clarified to specify that the defendant's liability covers future material and immaterial damages.

Motivazione estratta

The tenor was aligned with the trial court's reasons.
