Tenor

Der Antrag des Klägers, seine Verpflichtung zur Zahlung der Gerichtskosten nach einem Teil des Streitwerts zu bestimmen, wird zurückgewiesen.

Gründe

1 Der Antrag auf Festsetzung eines Teilstreitwerts ist unabhängig davon, ob er rechtzeitig gestellt ist (§ 247 Abs. 3 Satz 2 AktG), zurückzuweisen, weil die Rechtsverfolgung im Beschwerdeverfahren aussichtslos war. Der Antrag kann abgelehnt werden, wenn die Prozessführung völlig mutwillig oder aussichtslos ist (BGH, Beschluss vom 4. Juli 1991 - II ZR 249/90, ZIP 1991, 1581). Das Berufungsgericht hat die Klage abgewiesen und die Revision nicht zugelassen. Der Senat hat die dagegen gerichtete Nichtzulassungsbeschwerde mit Beschluss vom 5. April 2011 zurückgewiesen, weil kein Zulassungsgrund bestand.
