The Federal Court of Justice dealt with a revision in a civil dispute concerning the validity of a company agreement. After the plaintiff had been warned that the revision was hopeless and then withdrew it, the court declared the remedy forfeited. It also ordered the plaintiff to bear the costs of the revision.
§ 565 ZPO in conjunction with § 516 Abs. 3 ZPO; withdrawal of a revision: where the appellant withdraws the remedy, the court declares it lost and imposes the costs on the appellant. No substantive examination of the grounds of appeal is required once the revision has been withdrawn.

Zivilsenats des Oberlandesgerichts Düsseldorf zurückgenommen hat, dieses Rechtsmittels für verlustig erklärt.
Die Kosten der Revision werden ihr auferlegt (§§ 565, 516 Abs. 3 ZPO).
Streitwert: 4.762.202,90 € (§ 47 Abs. 1 Satz 1 GKG).

Consequence of the withdrawal of the revision
After the revision was withdrawn, it was declared forfeited.
A withdrawn revision no longer needs substantive adjudication; the court therefore terminates the remedy by declaring it lost.
Allocation of revision costs
The plaintiff must bear the costs of the revision.
Under the Code of Civil Procedure, costs follow the withdrawal of the appeal.
