Die Rechtsbeschwerde der Beteiligten zu 1. gegen den Beschluss der 8. Zivilkammer des Landgerichts Lüneburg vom 16. Juli 2010 wird auf deren Kosten zurückgewiesen.

Gründe

1 Die zulässige Rechtsbeschwerde hat keinen Erfolg.

2 1. Die Rechtsbeschwerde ist zulässig. Insbesondere ist sie gegen einen Beschluss zur Bestellung eines Betreuers auch ohne Zulassung durch das Beschwerdegericht statthaft (§ 70 Abs. 3 Satz 1 Nr. 1 FamFG i.V.m. Art. 111 Abs. 1 FGG-RG). Das Rechtsmittel konnte auf die Auswahl des Betreuers beschränkt werden (vgl. Senatsbeschluss vom 15. September 2010 - XII ZR 166/10 - FamRZ 2010, 1897 Rn. 10).

3 2. In der Sache hat die Rechtsbeschwerde jedoch keinen Erfolg.

4 Zwar weist die Rechtsbeschwerde zutreffend darauf hin, dass im Fall des § 1897 Abs. 4 Satz 1 BGB dem Tatrichter bei der Auswahl des Betreuers kein Ermessen zusteht. Es ist die Person zum Betreuer zu bestellen, die der Betreute wünscht (BayObLG FamRZ 2001, 1100 (Ls.); MünchKommBGB/Schwab 5. Aufl. § 1897 Rn. 21). Der Wille des Betreuten kann aber dann unberücksichtigt bleiben, wenn die Bestellung der vorgeschlagenen Person dem Wohl des Betreuten zuwiderläuft (BayObLG aaO; OLG Hamm FamRZ 2001, 254, 255). Dies setzt voraus, dass sich aufgrund einer umfassenden Abwägung aller relevanten Umstände Gründe von erheblichem Gewicht ergeben, die gegen die Bestellung der vorgeschlagenen Person sprechen. Es muss die konkrete Gefahr bestehen, dass der Vorgeschlagene die Betreuung des Betroffenen nicht zu dessen Wohl führen kann oder will (Senatsbeschluss vom 15. September 2010 - XII ZB 166/10 - FamRZ 2010, 1897 Rn. 20; BayObLG aaO; OLG Hamm aaO; MünchKommBGB/Schwab aaO § 1897 Rn. 21).

5 Das Beschwerdegericht hat ausführlich dargelegt, warum eine Bestellung der Beteiligten zu 1. zur Betreuerin dem Wohl der Betroffenen zuwiderlaufen würde. Gegen diese Ausführungen ist nichts zu erinnern. Die Feststellungen des Beschwerdegerichts rechtfertigen es, auch unter Berücksichtigung des Senatsbeschlusses vom 15. September 2010 (XII ZB 166/10 aaO), im vorliegenden Fall bei der Auswahl des Betreuers vom Wunsch der Betroffenen abzuweichen.

6 Von einer weiteren Begründung wird gemäß § 74 Abs. 7 FamFG abgesehen, weil sie nicht geeignet wäre, zur Klärung von Rechtsfragen grundsätzlicher Bedeutung, zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung beizutragen.
