The Federal Labour Court dismissed the claimant's revision against the judgment of the Lower Saxony Regional Labour Court. The parties had waived the statement of facts and reasons pursuant to Section 313a ZPO. The court ordered that the claimant bear the costs of the revision.
§ 313a ZPO; waiver of findings of fact and reasons; revision dismissed and costs of revision allocated to the losing party. Where the parties waive the statement of facts and reasons, the judgment may be rendered in abbreviated form. If the revision is unsuccessful, it is to be dismissed and the revision costs are borne by the appellant/lossing party (consid. 1).
