The Federal Labour Court decided an employment dispute in third instance. The parties had waived statement of facts and reasons under Section 313a ZPO. On the defendant's revision, and after rejecting the plaintiff's revision, the court set aside the Cologne Labour Court of Appeal judgment insofar as it had dismissed defendant 1's appeal, amended the Cologne Labour Court judgment to the extent it had upheld the claim, and dismissed the action entirely. The plaintiff was ordered to bear the costs.
§ 313a ZPO; waiver of statement of facts and reasons. Where the parties waive findings of fact and reasoning, the judgment may be rendered without a full written recitation of the facts and legal grounds. If the revising defendant succeeds, the appellate judgment may be set aside to the extent of the unsuccessful appeal, the first-instance judgment amended accordingly, and the claim dismissed in full; the unsuccessful plaintiff bears the costs.

Auf die Revision der Beklagten zu 1. wird - unter Zurückweisung der Revision der Klägerin - das Urteil des Landesarbeitsgerichts Köln vom 15. Januar 2015 - 8 Sa 40/15 - aufgehoben, soweit das Landesarbeitsgericht die Berufung der Beklagten zu 1. gegen das Urteil des Arbeitsgerichts Köln vom 7. Mai 2014 - 9 Ca 2161/13 - zurückgewiesen hat.
Auf die Berufung der Beklagten zu 1. wird das Urteil des Arbeitsgerichts Köln vom 7. Mai 2014 - 9 Ca 2161/13 - abgeändert, soweit es der Klage stattgegeben hat.
Die Klage wird insgesamt abgewiesen.
Die Klägerin hat die Kosten des Rechtsstreits zu tragen.
