The Federal Labour Court partly upheld the defendant's revision, partly set aside the judgment of the Schleswig-Holstein Regional Labour Court and the earlier judgment of the Neumünster Labour Court, and reformulated the operative part so that the claim is dismissed. The claimant was ordered to bear the costs. The decision was issued without findings of fact or reasons pursuant to Section 313a ZPO, as the parties had waived them.
