In this labour-law case, the Federal Labour Court ruled on the defendant's revision against judgments of the Labour Court Cologne and the Cologne Regional Labour Court. The parties had waived a statement of facts and reasons under Section 313a ZPO. The Court partially set aside the appellate judgment and amended the first-instance judgment by dismissing the claimant's request for an accounting statement. Auf die Revision der Beklagten wird das Urteil des Landesarbeitsgerichts Köln vom 9. Oktober 2014 - 7 Sa 322/14 - teilweise aufgehoben.
Auf die Berufung der Beklagten wird das Urteil des Arbeitsgerichts Köln vom 10. Januar 2014 - 19 Ca 9243/12 - teilweise abgeändert und der Klageantrag auf Erteilung einer Abrechnung abgewiesen.
Im Übrigen wird die Revision der Beklagten zurückgewiesen.
Der Kläger hat die Kosten des Rechtsstreits zu 9 % und die Beklagte zu 91 % zu tragen.
