The Federal Labor Court partly upheld the defendant's revision in a wage dispute. It set aside the Cologne Regional Labor Court judgment in part and amended the first-instance judgment to dismiss the request for issuance of accountings. In all other respects, it rejected the revision and left the payment order in place, clarifying that the award is for a gross amount. Costs were allocated 7% to the claimant and 93% to the defendant.

Art. 313a ZPO; partial revision in a wage dispute and clarification of the tenor of a payment order. Where the lower courts have granted both an accounting claim and a payment claim, the revision court may partially set aside the judgments and dismiss the accounting claim if it is unfounded, while otherwise leaving the payment award in force. A payment order may be maintained with the clarification that the amount is owed gross; the operative part must be formulated accordingly. If the parties waive findings of fact and reasons under Art. 313a ZPO, the judgment contains only the tenor and costs allocation.

Tenor

Auf die Revision der Beklagten wird das Urteil des Landesarbeitsgerichts Köln vom 9. Oktober 2014 - 7 Sa 388/14 - teilweise aufgehoben.
Auf die Berufung der Beklagten wird das Urteil des Arbeitsgerichts Köln vom 18. Dezember 2013 - 20 Ca 401/13 - teilweise abgeändert und der Klageantrag auf Erteilung von Abrechnungen abgewiesen.
Im Übrigen wird die Revision der Beklagten mit der Maßgabe zurückgewiesen, dass die Verurteilung zur Zahlung eines Bruttobetrags erfolgt.
Der Kläger hat die Kosten des Rechtsstreits zu 7 % und die Beklagte zu 93 % zu tragen.
