The Federal Labour Court dismissed the plaintiff’s revision against the judgment of the Hessian Regional Labour Court. The decision was rendered without a full statement of facts and reasons because, in view of parallel proceedings 4 AZR 50/13, the parties waived them. The plaintiff was ordered to bear the costs of the revision.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO: If the parties waive the statement of facts and reasons in view of parallel proceedings, the Federal Labour Court may decide the revision without setting out the facts and reasoning in full. A dismissed revision entails the costs of the revision for the appellant.
